You need to cv?sup your ports tree.
cd /usr/ports/sysutils/portupgrade && \
make deinstall clean install
This should get you the most current version of portupgrade
which has the patch, commited here:
http://lists.freebsd.org/pipermail/cvs-ports/2007-February/117217.html
