killing syslogd causes server panic

I have a script that runs every night. It uses the /etc/init.d/syslog
script to stop, then pwait to pause until the old syslogd dies, and then
/etc/init.d/syslog to start a new syslog daemon.
For some reason, syslogd doesn't always actually end and I'll log in and
find 15 syslogd processes running. When manually killing off the old
processes, the server will occasionally panic and reboot.
This has happened on Solaris 8 and 9 servers. A coworker said he'd
experienced a syslog reboot problem on older Solaris x86 installations but
they didn't match these symptoms. I have contacted Sun and they have no
idea why killing off a syslogd process would cause a system panic.
The server with 15 syslogd processes is Solaris 9 running on a V440 and at
patch level 118558-39.
Any suggestions?
