Many things happen even though they make no sense.

Take so-called "opt-in" lists, for example. By using the service
generating the list (home delivery of a purchased item, for example),
you are assumed to have opted-into the list and any generated from it.
Makes no sense, but that's how "the world" works.

Your other questions are entirely valid, of course. However, as I said:
How do you eat an elephant? One bite at a time. If it happens, it won't
be by unilateral choice or arbitrary action (example to the contrary:
Wal-Mart dictating that products ordered for sale in stores carry the
new RFID chip/tags by a date they dictate: RFID will happen anyway,
Wally World just wants it to happen by their say-so, instead of in the
normal course of events). There will be discussions, agreements and
negotiations, until some nit like BG comes along and tries to dictate.
