That might be the case, but then the solution is to change the situation legally, not just say "I don't like this law or how it came about,

There is nothing inherently wrong with the law. The problem is that the
MAFIAA (MPAA, RIAA) have failed to recognize a form of competition and
their need to change how they do business.

Does Kodak go about suing people left and right because they are taking
pictures without paying Kodak royalties for "film" ?. No. Kodak has
realised the precarious situation it is in with its core business (film)
evaporating into thin air and they are trying to find themselves a new
way to survive.

It wouldn't get them anywhere if they did. Selling the film does not give them any property rights in the resulting photograph!

Prior to the internet, people legally recorded music from radio onto
casettes so they could listen to it on their walkmans. This is really
not that different from the internet. MP3s are like casettes. Degraded
music quality that is good enough for a "walkman" (or "ipod" to use this
century's terminology).

It's okay to make a recording for your own personal use. I believe that is known as "fair use" q.v. It is NOT okay to use that recording for "elevator music", or to broadcast it over the radio without permission nor the internet either! Radio and TV stations must pay royalties for the use of any music that they do not own! Likewise, it is not okay to make and distribute copies, whether it's done over the internet or in any other way!

This is how the composer and the performers get paid. Your feeling that it ought to be free to everyone is not going to stand up in court! If you persist in publishing material you don't have rights to, you WILL wind up in court!
