ruby with portupgrade issue

Hello,
I run cvsup on my ports tree every few days, last night just happened to be
the night i ran it. Today i then ran portversion -l "<" and found out ruby
had a new version. So, i ran portupgrade -aFrR and grabbed all the dependent
files. Next having got them i ran portupgrade -arR and now i have a problem
with my portupgrade utilities and package management systems, fbsd 5.2. THe
portupgrade packages can't find /usr/local/bin/ruby yet pkg_info |grep ruby
shows it in the list, yet a pkg_delete ruby<version> says no such package is
installed.
Any help appreciated.
