There *are* shells with limits in the size of command line arguments.
Otherwise, why would switching shells often fix the problem?
One of the goals of the GNU utilities was in fact to remove arbitrary
limits in several common unix shells and utilities.
Exactly what kernel limitation are you talking about BTW?
