Hmm 9-10 should be OK..
Unfortunately the upgrade process can fail for seemingly inexplicable
reasons.
Once I found that having swap on slice 0 and root/swap mirrored with
metainit was enough to throw the upgrade process completely off.
The workaround was to "fix" one half the mirror at a time - a rather
convoluted process.
As a result, now I always make sure slice 0 is / and slice 1 is swap
on new disks : /
You may have to do a full backup and fresh install. Sorry, but it may
be quicker in the end.
Just for "fun" you could do a prtvtoc on the boot disk
I ran through a few iterations:

First the whole system was mirrored but I already deactivated that.
By now I did a new install of Sol9 on a single disk to verify the behaviour,
but still no luck. Since it is just a test system / is c0t0d0s0 and
swap c0t0d0s1 and the mirrors have been on the 0 and 1 partitions
as well.
